SOUTH DAKOTA BECOMES 20th STATE TO CALL FOR ARTICLE V CONVENTION

PIERRE, SOUTH DAKOTA – The South Dakota legislature has officially passed the Convention of States (COS) resolution. South Dakota is the 20th state to call for an Article V convention to discuss and propose constitutional amendments that reduce federal power, spending, and terms of office. 

Following a floor debate on February 4, 2025, the South Dakota House of Representatives voted __ - __  in favor of the measure, known as Senate Joint Resolution (SJR) 502. 

The Senate passed SJR 502 by an overwhelming 23-9 margin on January 21.

Sen. Jim Mehlhaff and House Majority Whip Leslie J. Heinemann were the primary sponsors of the resolution in their respective chambers.

The victory in the South Dakota legislature was borne of a decade of tireless work by COS volunteer grassroots activists, who engaged with fellow citizens and established productive and positive relationships with their state representatives and senators in order to gain passage of the COS resolution.

“Ten years of effort culminating in a single vote,” said Convention of States Action president and co-founder Mark Meckler. “It’s hard to appropriately express the amount of emotion I feel. I’m incredibly proud of our activists in South Dakota for their tenacity and hard work. And I’m proud of South Dakota for refusing to give in to the fear mongering of our opponents and instead joining the call for an Article V convention. South Dakotans are strong folks, and they intend to govern themselves, and not give in to the federal government.”

The COS South Dakota team provided compelling testimony in committee hearings in both chambers of the legislature, making the case for why the additional structural limitations on the federal government that only a limited-purpose Article V convention can bring about are reasonable and necessary.

The United States Constitution requires that 34 states are necessary to compel Congress to call an Article V convention. Due to the monumental efforts of the grassroots in South Dakota and their legislative champions in Pierre, we are one step closer to convention.
