Provisions not listed in the Oregon Ballot Measure 114 explanatory statement


Statewide ballot Measure 114 is twelve pages long, yet the explanatory statement is only allowed to be 500 words. Before voting on Measure 114 voters should be aware of provisions that are not described in the explanatory statement. If Measure 114 passes, the following changes will occur. Some of the changes listed below are not included in the explanatory statement. Permit required to purchase a firearm

1.     Requires permit issued by local police or county sheriff (permitting agent) to purchase a firearm. The applicant must sign the permit application in front of the police or sheriff, necessitating a trip to their office (Section 4, subsection (1), paragraph ©). The applicant must submit to being photographed and fingerprinted by police (Section 4, subsection (1), paragraph (e)).

2.     Oregon State Police (OSP) will obtain, “the applicant’s legal name, current address and telephone number, date and place of birth, physical description, and any additional information determined necessary by department rules” (Section 4, subsection (1), paragraph ©).

3.     Permitting agent may decline applicant’s request based on subjective criteria. The permitting agent only needs, “reasonable grounds,” that the applicant is a danger to self or others to deny the permit. The denial may be due to, “the applicant’s mental or psychological state” (Section 4, subsection (1), paragraph (b), sub-paragraph(C)).

4.     Applicant may appeal a permit denial but must pay all attorney expenses incurred during the appeal (Section 5, subsection (9)).

5.     Allows OSP to deny a firearm purchase request indefinitely, since no time limit is given for how long they may take to complete the mandatory background check (Section 6, subsection (3) paragraph ©).


Required training to obtain a permit to purchase

1.     Applicant must complete training course, submit to the same background check currently conducted for the purchase of a firearm, and pay a fee of up to $65 to obtain the permit (Section 4, subsection (3) paragraph (b). Training class must be taught by instructors certified by a law enforcement agency (Section 4, subsection (8), paragraph (a)). The instructor certification criteria are not specified. OSP rulemaking will determine course content and instructor certification criteria.

2.     Training class must include a review of up-to-date state and federal laws and safe practices related to ownership, purchase, transfer, use, storage, and transportation of firearms. Training class must include material on the “prevention of misuse of firearms, including the impact of homicide and suicide on families, communities, and the country as a whole” (Section 4, subsection (8), paragraph ©, subparagraphs (A), (B), and (C)).  No estimate of the training class length or cost is given.  

3.     The applicant must demonstrate in-person before an instructor certified by law enforcement how to lock, load, unload, fire, and store a firearm (Section 4, subsection (8), paragraph©, subparagraph (D).


Firearm and owner registration with Oregon State Police

1.     Requires OSP to maintain a searchable database of all permit holders (gun purchaser registration). “The department shall maintain the electronic database described in paragraph (a) of this subsection…” (Section 4, subsection (5), paragraph (b)).  The permit agent, “shall provide to the department a copy of the permit and any information necessary for the department to maintain an electronic searchable database of all permits issued under this section” (Section 4, subsection (5), paragraph (a)).

2.     Requires registration of all new gun purchases and transfers with the OSP. The OSP will collect information “sufficient to reflect each firearm purchased by a permit holder, which must be attached to the electronic record of the permit stored by the department” (Section 6, subsection (7), paragraph (a)).


Prohibits standard capacity magazines that hold more than ten rounds 

1.     Prohibits the purchase, sale, or transfer of all detachable magazines that hold more than ten rounds (Section 11, subsection (2)). Possession of magazines that hold more than ten rounds would be limited to at home, at a shooting range, while hunting, or in transit from one of those locations (Section 11, subsection (5), paragraph ©, sub-paragraphs (A)-(E)).
 
2.     Creates a misdemeanor crime of possessing a standard capacity magazine that holds more than ten rounds in public (Section 11, entire subsections (5)-(6)). 

3.     Prohibits the purchase, sale, or transfer of all fixed magazines that hold more than ten rounds, except those designed to accept .22 rimfire ammunition or those attached to a lever action firearm (Section 11, subsection (1), paragraphs (b)-(d), and sub-paragraphs (B)-(C)).  This prohibition will outlaw the possession of most pump and semi-automatic shotguns with tubular magazines.

4.     If owner of standard capacity magazine that holds more than ten rounds is charged with illegal possession, the owner must prove he/she owned the magazine before the effective date of this act to avoid prosecution. Alternatively, the owner may surrender the magazine to law enforcement prior to being charged (Section 11, subsection (5), paragraphs (a) and (d)). Most magazines do not contain a serial number or manufacture date, so it would be impossible for someone to prove that they owned the magazine before the Measure took effect.
